How much marijuana can one possess without it being a felony? There used to be a limit in grams, and if you were found to be in possession of more than that limit, then it was a felony, and below that it was a misdemeanor.

Because of recent changes to revised statute 40:966, on a first or second conviction, the limit is 2 1/2 pounds unless you have a prescription, and then it’s unlimited. However, keep in mind that possession with intent to distribute marijuana is still a felony and depending on circumstances, you could have much less than this maximum and still be found guilty of a felony if it looks like you were planning to distribute it. Also, remember that a third conviction of possession is also a felony.
